inheritance

At a glance

נחלהnachalah
inheritance, patrimony
the patrimony flowing down (Malbim, Rav Hirsch); one share among several (Shadal)
ירושהyerushah
inheritance
a bare legal transfer (Malbim); one heir, no one to share (Shadal)
אחוזהachuzah
holding
inherited property already taken in hand (Malbim)

In short

Several competing approaches separate nachalah from yerushah. Nachalah is inheritance in the sense of a patrimony: property that comes down the generations (Malbim), or one portion among several (Shadal). Yerushah is inheritance too. For Malbim it is a bare legal transfer, property that passes out of one man's reshus into another's with no assumption that it was willingly given; for Shadal it is inheritance with no one else sharing in it. Achuzah is the holding, inherited property the heir has actually taken hold of.

Distinctions

Nachalah (נחלה)

Root נ-ח-ל.

  • Malbim offers two ways of separating nachalah from yerushah. First: nachalah is specifically transgenerational, the transfer of property along the continuum from parent to child. Second: nachalah is specifically what the bequeather willingly passes on.
  • Shadal proposes a different distinction: a nachalah is what one receives as his share in the dividing up of a single estate, alongside others who take their portions in tandem; he even contends that nachalah is related to chelek ("portion"), both containing the ches-lamed combination. His two examples: the bechor's double share against his younger brothers' single shares is called nachalah (Devarim 21:16), and the seventy nations each received a nachalah when the world was divided among them (Devarim 32:8).
  • Rav Hirsch: nachalah is the preferred, more conservative of the two models of how a younger generation relates to an older one. It is cognate with nachal, a river; the estate flows on seamlessly and naturally, because the young see themselves as the continuation of the old and not as its replacement, and there is no repudiation on either side.

Yerushah (ירושה)

Root י-ר-ש.

  • Malbim: yerushah is related to reshus, "domain" or "charge," and denotes nothing more than property crossing from one party's domain into another's, sanctioned by the deceased or not.
  • Shadal: yerushah is the winner-takes-all case, one heir with no rivals to split with; hence Avraham Avinu, childless, complained that his household steward was seemingly destined to inherit everything, and the word he used was yoresh (Bereishis 15:3) and not nochel.
  • Rabbi Shlomo Pappenheim and Rabbi Yaakov Tzvi Mecklenburg: the root is reish-shin, allied to rosh, since the heir becomes the head of the estate he takes over. The English inherit comes from the Latin inhereditare, "to be appointed as heir," on which reckoning too the one who inherits assumes the deceased's position of power.
  • Rav Hirsch, in what Rabbi Klein calls an almost-prophetic reading of current events: yerushah belongs with geirush ("chasing away") and with Koresh, the Persian king who conquered the whole civilized world for himself, and who by some legends came to the throne by killing his own grandfather; it is the model in which the young generation treats itself as primary, rejects its connection to the past, and, bereft of its elders, is free to enjoy the fruits of what they built.

Others narrow both differently: nachalah is strictly father-to-son, while yerushah covers inheritance between relatives generally, even outside the direct line.

Rabbi Eliyahu Benamozegh (Eim LaMikra to Bereishis 38:17): Latin heres, the source of English heir, derives from yoresh.

Achuzah (אחוזה)

Root א-ח-ז, "to hold." Malbim: achuzah is inherited property of which the heir has already taken possession and now holds (ocheiz). Property not yet taken in hand, because it lies far off or is still disputed, is called nachalah or yerushah without the achuzah modifier. The word commonly appears in the construct achuzas nachalah.

Sefer HaShorashim

א-ח-ז

To take hold, to grasp. From this sense an inheritance is called אֲחֻזָּה, because a man takes hold in the place and is held secure there on its account.

Taking hold

(Tehillim 77:5), You held my eyelids, (Iyov 38:13), to take hold of the corners of the earth, וָאֹחֵז בְּפִילַגְשִׁי (Shoftim 20:6), and I took hold of my concubine, and (Shmuel II 2:21), and take hold for yourself of one of the young men. In the passive, נֶאֱחַז בַּסְּבַךְ (Bereishis 22:13), caught in the thicket, כַּדָּגִים שֶׁנֶּאֱחָזִים (Koheles 9:12), like fish that are caught, and וַיֵּאָחֲזוּ בָהּ, and they took hold in it. (Divrei HaYamim II 9:18), and a footstool of gold fastened to the throne, and (Iyov 26:9), He holds fast the face of the throne.

(Shir HaShirim 3:8), holding the sword, has the form of what is acted upon, in the way of (Shoftim 18:11), girded with weapons of war, and לָבוּשׁ בַּדִּים (Yechezkel 9:2), clothed in linen.

The beams that hold the walls

(Melachim I 6:10), and he held the house, means that he roofed it with cedar beams, and so Targum Yonasan renders it, וְטַלֵיל יַת בֵּיתָא, and he roofed the house; the pasuk uses a word of taking hold because the beams take hold of this wall and of the wall opposite, as it also says לְבִלְתִּי אֲחֹז בְּקִירוֹת הַבָּיִת (Melachim I 6:6), so as not to take hold in the walls of the house.

אֲחֻזָּה, a holding of land

From this sense comes (Bereishis 23:4), give me a holding for a burial place, and (Vayikra 25:45), and they shall be yours as a holding. An inheritance is called so because a man takes hold in the place and is held secure there on its account, as וַיֵּאָחֲזוּ בָהּ, and they took hold in it, and וְנֹאחֲזוּ בְתֹכְכֶם (Bamidbar 32:30), and they shall take hold among you.

(Bereishis 26:26), and Achuzzas his friend, is a man's name, and the Mesorah marks it לית שום בר נש, unique as a personal name. The Targum's view is וְסִיעַת מְרַחֲמוֹהִי, the company of his friends; on that view a man's company is called an אחוזה because they hold to him and do not part from him in his going out and his coming in.

י-ר-ש

To inherit, from a father or by taking what another held; to drive out, as it always is when bound with מ; in a sense close by, to make poor; and תִּירוֹשׁ, new wine.

Inheriting and taking possession

(Bamidbar 13:30), we shall take possession of it, and (Devarim 11:31), and you shall take possession of it and dwell in it. (Iyov 17:11) are the branchings of my heart: what the heart bequeaths and hands down, as though the branchings and thoughts of the heart were an inheritance, being ready and prepared for a man. All of them are one sense, he says, inheritance: some are a son's inheritance from his father, and some the taking of a thing out of another's hand, that is, taking his inheritance and what was in his holding, as a son takes his father's estate.

Where Rabbi Yonah reads otherwise

(Devarim 2:12) as: and the sons of Esav took their inheritance. There is no need, he says, to take these words out of the sense of inheriting, which Rabbi Yonah did, explaining them as sending away.

Driving out

In the sense of driving out and sending away: (Devarim 18:12), drives them out before you, and (Bamidbar 33:55), and if you do not drive out the inhabitants of the land before you. The rule, he says, is that wherever the word is bound to a מ it is driving out and sending away. The simple form has this sense too, in (Devarim 12:29), to drive them out before you; but it may be read as inheriting, with מפניך, before you, joined to כִּי יַכְרִית, when He cuts off, and not to לרשת, to inherit, and if so no simple form of the verb means driving out at all.

Making poor, and being made poor

In another sense close to it: מוֹרִישׁ וּמַֽעֲשִׁיר (Shmuel I 2:7), makes poor and makes rich, and תּֽוֹרִישֵׁמוֹ יָדִֽי (Shemos 15:9), my hand shall make them poor, though that may instead be from driving out. Likewise פֶּן־ תִּוָּרֵשׁ (Bereishis 45:11), lest you be made poor, and (Mishlei 30:9), lest I be made poor and steal: the sense of poverty and want. Targum Yonasan renders הַלְיָרְשֵׁנוּ קְרָאתֶם לָנוּ (Shoftim 14:15) from this sense, הַלְמַסְכְּנוּתָנָא קְרֵיתוּן יָתָנָא, have you called us to make us poor. Radak's own reading of it is: have you called us to take possession of our money, and if not, why have you called us? For it looked as though they had been called to have their money taken.

New wine

From this same root, he says, comes a noun that belongs to none of those senses, הַתִּירוֹשׁ, the new wine: כַּֽאֲשֶׁר יִמָּצֵא הַתִּירוֹשׁ בָּֽאֶשְׁכּוֹל (Yeshayahu 65:8), as the new wine is found in the cluster.

נ-ח-ל

To take as a possession, and to give one; נַחֲלָה, an inheritance. In another sense, נַחַל, the valley the water runs in, called so even when it is dry.

Taking a possession

(Yehoshua 14:1), and these are what the children of Yisrael took as a possession, (Bamidbar 32:19), for we will not take a possession with them, and (Bamidbar 34:18), to take the land as a possession. The simple verb, he says, takes one object only, the inheritance itself, so that (Bamidbar 34:17) is that they take the land as a possession on your behalf.

Yisrael as His inheritance

(Shemos 34:9), and pardon our iniquity and our sin and take us as a possession, means take us for Your own, that we be Your inheritance, as (Devarim 9:29), they are Your people and Your inheritance. So of Yehudah, אֶת־יְהֹוּדָה חֶלְקוֹ (Zecharyah 2:16), Yehudah His portion: Yehudah will be Hashem's inheritance forever on the holy soil. (Tehillim 82:8), for You take possession among all the nations, he reads with what the mizmor says at its opening, עַד מָתַי תִּשְׁפְּטוּ עָוֶל, how long will you judge wrongly, and with קוּמָה אֱלֹהִים שָׁפְטָה הָאָרֶץ, arise, Elokim, judge the land: take the judgment of the poor and of those who cry out against violence from the hands of the wicked, the unjust judges, for You take the poor as Your possession among all the nations. In whatever nation the poor and the robbed are found, they are Your people and Your inheritance, and You will take them for Your own and save them from the hand of their oppressors.

Where it takes two objects

(Yehoshua 13:32), these are what Moshe gave as inheritances in the plains of Moav, and (Yehoshua 1:6), for you will give this people its inheritance; so (Devarim 21:16), on the day he gives his sons their inheritance, and (Devarim 32:8), when the Most High gave the nations their inheritance. In the passive, כֵּן הָנְחַלְתִּי לִי יַרְחֵי שָׁוְא (Iyov 7:3), so months of emptiness were given me for a portion; and turned back on itself, וְהִתְנַחַלְתֶּם אֹתָם (Vayikra 25:46), where he reads אֹתָם as מהם: you shall take a possession from them, like הֵם יָצְאוּ אֶת הָעִיר (Bereishis 44:4), they had gone out from the city.

(Yechezkel 22:16) may be taken from this root, though he explained it at חָלַל; its proper form would then be וְנִנְחַלְתְּ, and but for the ches it would carry a dagesh. Taken so, it means: until now you were My inheritance, but since you have sinned you are not; you will be inherited by yourself and not by Me, in the sight of the nations.

נַחַל, the water-course

(Iyov 28:4), a stream breaks out, (Melachim I 17:4), you will drink from the נַחַל, with the dual אֶל כָּל אֲשֶׁר יָבוֹא שָׁם נַחֲלַיִם יִחְיֶה (Yechezkel 47:9), everything to which the two streams come will live, and the plural (Koheles 1:7), all the streams go to the sea. The valley in which the waters run is called a נַחַל, and even when there is no water in it, it is still called so, since the place is what bears the name, as וְהָעִיר אֲשֶׁר בַּנַּחַל (Devarim 2:36), and the city that is in the valley. אֶל נַחַל אֵיתָן (Devarim 21:4), to a strong נַחַל, had water in it, since it is written there that they wash their hands; and so וּצְדָקָה כְּנַחַל אֵיתָן (Amos 5:24), and righteousness like a strong נַחַל, is one whose waters sweep down with force. (Iyov 20:17), rivers of streams of honey and butter, one construct comes upon another.

(Tehillim 5:1), for the conductor, on the נְחִילוֹת, is the name of a tune they knew. Rabbeinu Hai explained the word from (Bava Kamma 10:2), a swarm of bees; that is, its tune was like the whistling of bees.
